Terms and Conditions – Classic Escapes

(A Unit of Dhiaan Global Associates LLP)

These Terms and Conditions (“Terms”) govern all enquiries, quotations, bookings, payments, and travel arrangements made through Classic Escapes, a unit of Dhiaan Global Associates LLP (hereinafter referred to as “the Company”, “we”, “us”, or “our”), whether via our website www.classicescapes.in, email, phone, WhatsApp, or any other channel.

By making an enquiry, booking, or payment with Classic Escapes, you (the “Client”, “Traveler”, “Guest”, or “you”) agree to be bound by these Terms, along with our Cancellation Policy, Privacy Policy, and any supplier-specific terms communicated to you.

1. Role of Classic Escapes

1.1 Classic Escapes acts as an intermediary/agent for independent third-party travel suppliers such as airlines, railways, hotels, resorts, cruise lines, ground transport operators, activity providers, and destination management companies (“Suppliers”).

1.2 We do not own, manage, operate, or control any Supplier. All travel services are subject to the terms, conditions, and limitations of the respective Supplier.

1.3 Wherever applicable, Supplier terms (including cancellation policies, change fees, refund rules, and liability limits) shall take precedence over any general description provided by Classic Escapes.

2. Booking, Availability, and Pricing

2.1 All air seats, train berths, hotel rooms, vehicle allocations, and activity slots are subject to availability at the time of confirmation.

2.2 Prices quoted are based on availability, exchange rates, taxes, and Supplier tariffs at the time of quotation. We reserve the right to revise prices until full payment and written confirmation are received.

2.3 In case of unavailability in the listed hotels, arrangement for an alternate accommodation will be made in a hotel of similar standard. Any price difference, if applicable, shall be borne by the Client unless otherwise agreed in writing.

2.4 The package price does not include expenses of a personal nature, such as laundry, telephone calls, room service, alcoholic beverages, mini-bar charges, tips, portage, camera fees, travel insurance, visa fees, or any other item not explicitly mentioned in the itinerary/invoice.

3. Payment Terms and Policies

3.1 Standard Tour Packages (Departures > 60 Days from Booking Date)

3.1.1 For departures scheduled more than 60 days from the booking date:

  • non-refundable deposit of 10% of the total package cost is required at the time of booking to confirm the reservation.
  • The remaining balance must be paid no later than 60 days prior to the departure date.

3.1.2 Failure to pay the balance by the 60-day deadline may result in:

  • Cancellation of the booking, and
  • Application of cancellation charges as per our Cancellation Policy and applicable Supplier rules.

3.1.3 In such cases, Classic Escapes shall not be liable for any price escalation, loss of availability, or changes in itinerary due to delayed payment.

3.2 Flights, Trains, and Hotels with Dynamic or Special Discounted Rates

3.2.1 Certain inventory types—such as airline tickets, train tickets, and hotel rooms booked under dynamic pricing, special discounted rates, promotional fares, group fares, or non-refundable/non-changeable tariffs—may require 100% payment at the time of booking.

3.2.2 For such bookings:

  • The full amount is due immediately to secure the reservation.
  • These bookings are typically non-refundable and non-changeable, unless the Supplier explicitly allows changes with penalties.
  • Any reissue, name correction, date change, or cancellation will attract Supplier penalties plus our service fees, where applicable.

3.2.3 Clients will be informed at the time of quotation if a particular fare or rate requires 100% advance payment. Proceeding with payment constitutes acceptance of these conditions.

3.3 Weddings, Incentive Trips, and Peak Season Bookings

3.3.1 For wedding groups, MICE/incentive trips, large group movements, and peak season travel (including festivals, long weekends, and high-demand periods), payment terms may differ based on Supplier requirements and event complexity.

3.3.2 In such cases:

  • A customized payment schedule will be provided at the time of proposal confirmation or proforma invoice.
  • This may include multiple milestones (e.g., initial token advance, rooming-list-based payments, final settlement timelines).

3.3.3 Clients must adhere strictly to the agreed payment milestones. Any delay may lead to:

  • Release of blocked inventory (rooms, vehicles, event spaces), and
  • Price revisions or cancellation as per Supplier policy.

3.4 Mode of Payment and Receipts

3.4.1 Payments can be made via bank transfer, UPI, credit/debit card, or other modes as specified in the invoice.

3.4.2 All payments must be made in favor of Dhiaan Global Associates LLP – Classic Escapes or as instructed in the official invoice.

3.4.3 Payment confirmation will be issued via email/WhatsApp once funds are realized. Clients should retain this confirmation for their records.

3.5 Currency and Exchange Fluctuations

3.5.1 For international packages or services priced in foreign currency, all quotations are subject to exchange rate fluctuations until full payment is received.

3.5.2 Significant currency movements may necessitate a price revision, which will be communicated before confirmation. Once confirmed and fully paid, the price will not change unless the scope of services changes.

3.6 Taxes and GST

3.6.1 All amounts are exclusive of applicable taxes unless stated otherwise.

3.6.2 GST will be charged as per prevailing Indian tax laws:

  • 5% GST on tour packages (without input tax credit), and/or
  • 18% GST on commission/consultancy or standalone booking services, as applicable.

3.6.3 Any changes in tax rates, regulations, or interpretations by authorities will be reflected in subsequent invoices.

4. Itinerary and Service Modifications

4.1 Classic Escapes reserves the right to modify the itinerary at any point, due to reasons including but not limited to:

  • Force Majeure events (acts of God, natural disasters, epidemics/pandemics, government advisories, border closures, war, terrorism, civil unrest)
  • Strikes, fairs, festivals, or local disruptions
  • Weather conditions, traffic problems, or road closures
  • Overbooking of hotels/flights or cancellation/re-routing of flights/trains
  • Closure of or entry restrictions at a place of visit
  • Operational or safety reasons

4.2 While we will do our best to make suitable alternate arrangements, we would not be held liable for any refunds/compensation claims arising out of this, except as required by law.

5. Cancellations, Refunds, and No-Shows

5.1 Cancellation requests must be made in writing (email) to Classic Escapes. The date of receipt of such email shall be treated as the cancellation date.

5.2 Cancellation charges will be as per:

  • Our published Cancellation Policy, and
  • The applicable Supplier cancellation terms (airlines, hotels, transport, activities, etc.).

5.3 For standard tour packages where the 10% deposit applies:

  • The initial 10% deposit is non-refundable in most cases, as it covers administrative costs and blocked inventory.
  • Additional cancellation charges will apply depending on how close to departure the cancellation occurs, as detailed in our Cancellation Policy.

5.4 For fully prepaid flights, trains, and special-rate hotels:

  • These may be entirely non-refundable, with no refund even in case of cancellation by the Client.
  • Any partial refunds (if allowed by the Supplier) will be passed on after deducting applicable penalties and our service fees.

5.5 There will be no refund for unused nights or early check-out. In case of a medical condition, refund (if any) will be strictly as per hotel policy.

5.6 In case of flight/train cancellations by the Supplier, Classic Escapes will assist with rebooking or alternate options, but any additional cost incurred (fare difference, reissue fees, etc.) shall be borne by the TravelerClassic Escapes will not be liable to provide any alternate flights within the same cost.

6. Check-in / Check-out and Hotel Policies

6.1 Check-in and check-out times at hotels would be as per hotel policies. Standard times are commonly 12:00–14:00 for check-in and 10:00–12:00 for check-out, but may vary by property.

6.2 Early check-in or late check-out is subject to availability and may be chargeable by the hotel.

6.3 Any damage caused to hotel property by the Client or their companions shall be the sole responsibility of the Client, and costs will be payable directly to the hotel or via Classic Escapes as applicable.

7. Health, Safety, Medical Emergencies, and Insurance

7.1 Travelers are responsible for ensuring they are medically fit to travel. Pre-existing conditions, pregnancy, mobility issues, or special medical requirements should be disclosed at the time of booking.

7.2 In case of any health issues, Classic Escapes will not be liable to provide any refunds.

7.3 In case of medical emergencies, all medical expenses (including hospitalization, treatment, evacuation, repatriation, etc.) shall be borne by the customer.

7.4 Classic Escapes is not liable for any compensation or additional arrangements necessitated by health issues, unless required by law or explicitly covered under a travel insurance policy purchased by the Client.

7.5 Advisory on Medical and Travel Insurance
It is strongly advisable that all passengers traveling on any itinerary arranged by Classic Escapes purchase comprehensive medical and travel insurance before commencement of travel. Such insurance should, at minimum, cover:

  • Medical emergencies and hospitalization
  • Emergency medical evacuation and repatriation
  • Trip cancellation or curtailment due to illness or other covered reasons
  • Loss or delay of baggage and personal belongings
  • Personal accident and liability

Classic Escapes can assist in connecting Clients with insurance providers, but the decision to purchase, the choice of policy, and the adequacy of coverage remain the sole responsibility of the Client.

8. Travel Documents, Visas, and Compliance

8.1 It is the Client’s responsibility to ensure that they possess all necessary passports, visas, permits, vaccinations, and health certificates required for the journey.

8.2 Classic Escapes may provide general guidance on visa and document requirements, but we do not guarantee visa approval or entry into any country.

8.3 Any denial of boarding, entry, or transit due to incomplete or incorrect documentation shall be the sole responsibility of the Client, and no refund will be provided for unused services.

8.4 Clients must comply with all applicable laws, regulations, and advisories of the origin, transit, and destination countries, including customs, immigration, and security rules.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Classic Escapes’ (and Dhiaan Global Associates LLP’s) total liability arising from or relating to any booking or travel arrangement shall not exceed the total service fees paid by the Client to Classic Escapes (excluding amounts paid to Suppliers on the Client’s behalf).

9.2 We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of enjoyment, mental distress, or loss of opportunity.

9.3 Classic Escapes is not responsible for delays, cancellations, strikes, accidents, injuries, theft, loss of baggage or personal belongings, or any other incidents caused by Suppliers, third parties, or circumstances beyond our reasonable control.

 

10. Force Majeure

10.1 Neither party shall be liable for failure or delay in performing obligations under these Terms where such failure results from circumstances beyond reasonable control, including but not limited to:

  • Acts of God, natural disasters, epidemics/pandemics
  • Government actions, advisories, restrictions, or border closures
  • War, terrorism, civil unrest, strikes, or Supplier insolvency

10.2 In such events, Classic Escapes will endeavour to mitigate impacts and explore alternatives, but any additional costs or losses shall be borne by the Client, subject to applicable Supplier refunds or insurance claims.

11. Client Responsibilities and Conduct

11.1 Clients must provide accurate information at the time of booking, including full names (as per passport), dates of birth, contact details, and special requirements.

11.2 Any error in names, dates, or other details that leads to reissue fees, penalties, or denial of travel shall be borne by the Client.

11.3 Clients are expected to maintain appropriate conduct during the trip. Misbehavior, violation of local laws, or breach of Supplier policies may result in termination of services without refund, and the Client may be held liable for any resulting damages or penalties.

12. Privacy and Data Use

12.1 Personal data collected from Clients will be used in accordance with our Privacy Policy and applicable Indian laws.

12.2 We may share necessary traveler information with Suppliers (airlines, hotels, transport operators, etc.) strictly for the purpose of fulfilling the booking.

12.3 We do not sell or rent personal data to third parties for marketing purposes without consent, except as required by law or for operational purposes with trusted service providers under confidentiality obligations.

13. Intellectual Property and Website Use

13.1 All content on www.classicescapes.in, including text, images, logos, itineraries, and designs, is the property of Dhiaan Global Associates LLP or its licensors and is protected by applicable copyright and trademark laws.

13.2 You may access and use the website for personal, non-commercial purposes only. Reproduction, redistribution, or commercial use of any content without prior written permission is prohibited.

14. Governing Law and Dispute Resolution

14.1 These Terms shall be governed by and construed in accordance with the laws of India.

14.2 Any disputes arising out of or in connection with these Terms or any booking shall be subject to the exclusive jurisdiction of the courts at Coimbatore, Tamil Nadu, unless otherwise mandated by law.

14.3 Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiations or mediation.

15. Changes to These Terms

15.1 Classic Escapes (Dhiaan Global Associates LLP) reserves the right to update, modify, or replace these Terms at any time.

15.2 The latest version will be posted on our website with an updated “Last Revised” date. Continued use of our services after such changes constitutes acceptance of the revised Terms.
